Dalam semangat pencegahan korupsi dan panduan dalam menerima pemberian/hadiah pasca perayaan hari raya, KPK mengingatkan kembali mengenai batasan gratifikasi berdasarkan Peraturan Komisi Pemberantasan Korupsi Republik Indonesia Nomor 2 Tahun 2019 tentang Pelaporan Gratifikasi yang mengatur pengecualian terhadap beberapa jenis pemberian yang dianggap tidak memiliki potensi benturan kepentingan dan oleh karenanya dianggap legal untuk diterima.
Berikut adalah kategori gratifikasi yang masih dapat diterima dengan tetap memperhatikan prinsip kehati-hatian dan transparansi, yaitu:
- Pemberian dalam keluarga sepanjang tidak ada konflik kepentingan;
- Keuntungan penempatan dana/investasi atas kepemilikan saham pribadi;
- Seminar kit dalam kegiatan kedinasan berlaku umum;
- Hadiah kejuaraan/perlombaan yang diikuti dengan biaya sendiri dan tidak terkait kedinasan;
- Hadiah, undian, diskon, voucher, point reward, souvenir tidak terkait kedinasan dan berlaku umum;
- Honorarium, transportasi, akomodasi sesuai SBU dan tidak melanggar aturan internal instansi;
- Hadiah pernikahan, akikah, upacara adat/agama maksimal senilai Rp1juta per pemberi;
- Hidangan/sajian berlaku umum;
- Pemberian sesama rekan kerja tidak dalam bentuk uang dalam rangka pisah sambut/ulang tahun maks. Rp300ribu per pemberi Rp1juta setahun;
- Sumbangan musibah/bencana bernilai wajar sepanjang tidak terdapat konflik kepentingan;
- Manfaat dari korperasi, organisasi pegawai berdasarkan keanggotaan berlaku umum;
- Pemberian sesama rekan kerja tidak dalam bentuk uang, tidak terkait kedinasan maks. Rp200ribu per pemberi Rp1juta setahun;
- Perangkat sosialiasi menggunakan logo atau pesan sosialiasai berlaku umum;
- Penghargaan berupa uang/barang karena prestasi kerja yang diberikan pemerintah sesuai UU;
- Kompensasi/honor atas profesi diluar kedinasan dan tidak terkait tugas dan kewajiban;
- Cenderamata/plakat kepada instansi dalam rangka hubungan kedinasan dan kenegaraan;
- Karangan bunga dalam rangka perayaan/upacara adat atau agama, pisah sambut/promosi jabatan.
Apabila pemberian yang diterima tidak termasuk ke dalam 17 jenis di atas, maka pemberian tersebut termasuk gratifikasi yang wajib dilaporkan melalui Aplikasi GOL atau gol.kpk.go.id dalam jangka waktu 30 hari kerja sejak tanggal penerimaan. Jika memungkinkan, tolak segala bentuk gratifikasi yang berpotensi menimbulkan benturan kepentingan di kemudian hari.
